1) Parent/Guardian Authority
I am the parent or legal guardian of the minor child(ren) named below and have full authority to sign this agreement on their behalf and on my own behalf.
2) Nature of Activities & Inherent Risks
I understand that agritourism and farm-related activities may include, without limitation, uneven terrain; interaction with animals; proximity to farm equipment; variable weather and environmental conditions; and other natural hazards. I understand these are inherent risks that cannot be entirely eliminated.
3) Assumption of Risk (Parent/Guardian on behalf of Minor)
To the fullest extent permitted by law, I freely assume all risks of participation for myself and for the minor child(ren) in my care, including risks arising from the inherent conditions of the Farm and activities.
4) Release, Waiver, and Covenant Not to Sue
To the extent permitted by Arkansas law, I release, waive, and agree not to sue Holland Bottom Farm, LLC; its owners, members, employees, agents, insurers, volunteers, and affiliates (including Yours, Mine, & Ours, LLC), from claims, demands, or damages of any kind arising out of or related to our participation in Farm activities, except to the extent caused by the Farm’s gross negligence or willful misconduct (which are not waived).
5) Wristband Condition of Entry
I understand a Farm-issued wristband is visible confirmation that this waiver has been signed and accepted. No wristband will be issued until this waiver is signed, and entry into any activity area without a wristband is prohibited. Lost wristbands may require re-verification.
6) Rules & Removal
I agree that my child(ren) and I will comply with all posted signs, safety rules, and staff instructions. I understand that failure to do so may result in immediate removal of me and/or any minor(s) in my care without refund.
7) Medical Authorization
If first aid or emergency care is needed, I authorize the Farm and its personnel to obtain medical treatment for my child(ren) and me, and I accept responsibility for related costs. I certify that my child(ren) can safely participate in typical farm/agritourism activities or that I have notified the Farm of limitations above.
8) Transportation & Supervision
I understand that transportation to/from the Farm may be provided by the school or third-party carriers, and that supervision at the event involves both school chaperones and Farm staff. I agree to follow all supervision instructions.
9) Indemnification
To the extent permitted by law, I agree to indemnify and hold harmless the released parties identified above from claims brought by or on behalf of my child(ren) arising from our participation, except to the extent caused by the Farm’s gross negligence or willful misconduct.
10) Miscellaneous
This agreement will be governed by Arkansas law. If any part is found unenforceable, the remainder remains in effect. This document is intended to be broad but lawful and read together with posted warnings and Farm rules.
